Hours of work:

The standard working week in Australia is 38 hours.Awards,certified agreements and Australian Workplace Agreements generally contain provisions setting out ordinary hours of work,rest breaks and overtime and penalty rates.The average number of hours paid for in 2000 for full-time,adult,non-managerial employees was 39.8 hours.

Only a Full Bench of the AIRC may vary standard hours clauses in awards(s 106).Many workers are able to use flex time‖;this permits a worker to flexibly vary their working hours over a set period.

Sick leave is granted to most workers under awards or agreements and some State legislation also sets out minimum entitlements.

Leave for trade union purposes, educational leave and leave relating to the holding of public office are unlikely to be ever included in a federal award (see Workplace Relations Act 1996 (ACTH) s 89A), but provision can be (and is) made for these types of leave in statutory employment agreements and State awards.

 

 

2.Alcohol laws of Australia regulate the sale and consumption of alcoholic beverages (in Australia also referred to as liquor). The laws vary between the states.

    

Alcohol may not be sold in Victoria without a license or permit being obtained from the State government. License and permits are issued by the Victorian Commission for Gambling and Liquor Regulation,under the Liquor Control Reform Act 1998.

In Victoria, alcohol may not be sold to a person who is under 18 years of age unless accompanied by a guardian (or spouse) and for consumption during a meal,[13]and minors must not be on licensed premises (i.e. premises on which alcohol may be sold or consumed) unless accompanied by an adult or other limited circumstances.

Other specialist license are: full club license, renewable limited club license, temporary limited license, renewable limited license, restricted club license, ore-retail license (for wholesalers, producers, brewers and liquor importers), and vignettes license.

There are several areas in Melbourne which retain the status of "dry-areas", where a vote is required before a liquor license is granted within the area.

Some local government councils have passed by-laws prohibiting the consumption of alcohol on streets within their areas.[citation needed]

In Victoria, if a minor is caught with alcohol in public it can be confiscated and guardians notified of the offense, and a fine may occur.

In Victoria, fully licensed drivers of motor vehicles must have a Blood alcohol content (BAC) below 0.05%. Learner and probationary licensed drivers must not consume any alcohol before driving (i.e. the BAC must be zero).

Victorian alcohol laws only allow the following identification as legally accepted proof-of-age in licensed premises:

Current Australian Driver License

Current Australian Learner Driver Permit Card

Current passport (Australian or foreign)

Current NSW Proof-of-Age Card (if they don't already have a driver's license)

5.The Privacy Act 1988 (Privacy Act) is an Australian law which regulates the handling of personal information about individuals. This includes the collection, use, storage and disclosure of personal information, and access to and correction of that information. If you violate the privacy legislation, you may face the risks and penalties as below:

Penalties for violations. If the HITECH Act is violated due to willful neglect, HHS may be required to assess a penalty in the amount of $50,000 per violation, with no maximum penalty for multiple violations. The term “willful neglect” is not defined, but presumably that standard will apply whenever there is a failure to adopt safeguards and procedures required by law. Lesser penalties may be imposed where the violation does not result from willful neglect, or is corrected within 30 days of the date it is discovered (or should have been discovered).

Enforcement. The Secretary of HHS is required to investigate cases involving possible willful neglect that arise from preliminary investigation of complaints. Regulations to be issued within 3 years will allow harmed individuals to share in penalties collected under the Act, which should increase the likelihood and frequency of complaints. State Attorneys General may also sue under the HITECH Act to obtain an injunction or damages of up to $25,000, increasing the likelihood of uneven interpretation of the law in all 50 states.

Plan sponsors should act quickly to limit their exposure under the HITECH Act. Many of the provisions are subject to guidance that will be issued over the next three years, but there are steps that can and should be taken now. They include the following:

Update business associate agreements. HIPAA requires that transmission of PHI between health plans and third party service providers (“business associates”) be subject to a written contract (a “business associate agreement”). The HITECH Act requires that every business associate agreement be updated to reflect the new privacy and security requirements. In addition, the HITECH Act expands the definition of business associate to include data transmission service providers. Group health plans should identify all service providers, assess whether a business associate agreement is required, and update those agreements accordingly. Because of the enhanced risk of penalties and notification requirements, those agreements should be reviewed by legal counsel.
